Queensland Medical specialists challenge vaccine mandate

A group of eleven medical specialists and GPs in Queensland have launched legal proceedings challenging the Chief Health Officer’s vaccine mandate.

The group’s review application to the Supreme Court claims that each doctor’s ability to continue to practice medicine has suffered a detriment, by removing, limiting, or entirely preventing their ability to do so.

NR Barbi law firm, who filed the application said there was no probative evidence to justify the decision, claiming it was an improper use of power. The application also claims that Chief Health Officer Dr John Gerrard had no jurisdiction to authorise the public health direction to mandate vaccination for workers across multiple health care settings.

One of the applicants, Mr. McIntyre, said that there were up to 40 other doctors supporting the legal challenge, but said many were not prepared to come forward publicly out of fear of reprisal.

Dr McIntyre said the Australian Health Practitioner Regulation Agency (AHPRA) threatened doctors with deregistration for speaking out against the government narrative.

The doctor, who confirmed his daughter; a radiographer; had also been ‘mandated out’ added,

“I’ve had a huge loss of income. I’m mandated out. I can’t work. It’s forced retirement.”

Health Minister Yvette D’Ath said, “As we have throughout the pandemic, we will follow the health advice because this is what has kept Queenslanders safe,” but offered no further comment regarding the application before the court.

Dr McIntyre; part of the specialist group comprising an obstetrician, a gynecologist, a child psychiatrist, a radiologist, a neurosurgeon, an anesthetist, a pediatrician, and other specialists; said,

“The whole emergency declaration and mandate needs to be heavily reviewed.”

“We are not anti-vaxxers. We are anti the COVID-19 response,” he said.

Previous challenges launched by teachers, nurses, ambulance officers, police, childcare workers, and prison officers against the states’ mandate are still currently before the court.
